AS Monaco appeals to CNOSF

The Principality club has resorted to its last chance after being excluded from the Betclic Elite league by the French Basketball Federation's appeals chamber. This decision upheld the verdict of the DNCCG. AS Monaco announced on Tuesday evening that it is appealing to the French National Olympic and Sports Committee (CNOSF) with the aim of securing its place back in the Betclic Elite through a conciliation procedure, thereby seeking a review of its admission for the 2026-2027 season.

The club stated in a press release, "The club remains fully committed to exploring all legal avenues provided by French sports law, while continuing its restructuring process in close collaboration with its institutional partners."

On Monday, August 3rd, Xavier Le Cerf-Galle, the lawyer for AS Monaco, expressed a glimmer of hope in a statement to Nice Matin. He explained that AS Monaco Basket is actively working on a recovery plan satisfactory to both Monegasque and sports authorities, with advanced discussions underway. The club is reportedly free of all debts to employees, social funds, the LNB, the FFBB, and its suppliers. This presents an opportunity for a buyer to take over a financially sound club, provided they meet the financial guarantees required by management control and the legitimate demands of the Principality's authorities, whose support has been unwavering.

The lawyer further clarified that discussions are ongoing with Jamal Mashburn and that the club is also seeking other potential investors. He acknowledged the tight deadlines that hindered mandatory legal and compliance operations in the US, Monaco, and France, noting that earlier engagement between lawyers could have prevented time constraints. Mashburn's non-commitment was attributed to personal reasons not for him to comment on.

"All I can say is that the initial intention was genuine and sincere, the financial support capacities were real, and the obstacles that led to the non-finalization of the takeover plan at the specified time could have been resolved with a few more days," the club's lawyer continued. "However, thinking and saying this does not guarantee anything. The LNB and FFBB require tangible and documented guarantees. I've read that there are potential buyers. Nothing prevents them from contacting the club's lawyer to present their project and provide proof of the necessary financial guarantees."

He concluded, "AS Monaco Basket will only appeal to the CNOSF within the legal timeframe if the recovery plan is signed and the financing is documented. Otherwise, the sports authorities will be informed, and a registration dossier for NM1 will be submitted."
